Welcome to BAG À LUX, operated by Bagalux Marbella S.L. and Panda Sport 2020 S.L. ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website www.bagaluxboutique.com (the "Website"), dedicated to the sale of authenticated pre-owned luxury goods.

By accessing or using our Website, you accept and agree to be bound by these Terms, along with our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Website.

1. Purpose of the Website

The Website is operated exclusively by BAG À LUX, a professional retailer of authenticated second-hand luxury goods.

All products available for sale on our Website are:

- Acquired directly by BAG À LUX from private individuals or companies, or

- Accepted on consignment under strict quality control and authentication processes performed by BAG À LUX

All products are pre-owned, authenticated, and subject to a quality control process before being listed for sale.

Users who choose to register must provide accurate, complete, and up-to-date information and are responsible for maintaining the confidentiality of their account credentials.

BAG À LUX is not responsible for unauthorized access to user accounts.

6. Conditions of Sale

Authenticity: All products undergo a thorough authentication process prior to sale.

Pre-Owned Condition: Products are sold as pre-owned, and may show minor signs of previous use, which will be disclosed when material.

Acceptance of Condition: By purchasing, the customer acknowledges and accepts the second-hand nature and possible minor imperfections of the products.

7. Pricing and Payments

Prices: All prices are listed in Euros (€).

Special Tax Regime: In accordance with Spanish tax regulations for second-hand goods, sales are subject to the Special Regime for Used Goods (REBU). Therefore, no VAT breakdown will be shown on invoices.

Payments: Accepted payment methods include bank transfer and credit/debit card in the boutique.

8. Shipping and Delivery

Shipping Costs: Shipping is managed and fully covered by BAG À LUX at no additional cost to the customer.

Shipping Terms: Estimated delivery times and terms will be specified at checkout.

Liability: BAG À LUX is not responsible for delays or damages caused by third-party courier services.

9. Returns and Refunds

Given the nature of pre-owned goods:

Returns: Accepted only if the product received is materially different from the description or if hidden defects are discovered.

Return Period: 15 calendar days from the date of receipt.

Refunds: Processed after the returned item has been received and inspected. Refunds will be issued via the original payment method.

Note: Normal signs of use and wear consistent with pre-owned goods are not considered defects and do not constitute valid grounds for return.

10. Warranty Conditions

BAG À LUX offers a 12-month (1 year) limited warranty on all products sold, subject to the following conditions.

Warranty and Responsibility – Watches

Bagalux Marbella S.L. certifies that all watches offered for sale are original, genuine, and correspond exactly to the photographs and descriptions displayed on our Website at the time of purchase.

In the event of any discrepancy between the received product and the published photographs or descriptions, Bagalux Marbella S.L. commits to fully refunding the purchase price, with no additional compensation or indemnity.

All watches are covered by a 12-month (1 year) limited warranty from the date of purchase against internal mechanical defects arising from normal use.

The warranty explicitly excludes:

- Damages caused by drops, impacts, or improper handling.

- Water damage, including but not limited to submersion, moisture exposure, or operating the crown or buttons underwater.

- Wear and tear, scratches, or aesthetic deterioration caused by use.

- Any damage resulting from unauthorized interventions, modifications, or repairs.

Important:

Any manipulation or service performed by parties not authorized by BAG À LUX will void the warranty.

Claims under warranty must be accompanied by the original invoice issued at the time of sale.

Warranty and Responsibility – Handbags

All handbags sold by BAG À LUX include a 12-month (1 year) limited warranty from the date of purchase, covering hidden defects related to the structure or craftsmanship of the item.

This warranty does not cover:

- Scratches, scuffs, creases, or marks resulting from regular use or accidental impacts.

- Stains or damage caused by external substances (e.g., liquids, oils, ink, cosmetics).

- Normal wear and tear consistent with the nature of pre-owned products.

Only claims for defects arising under normal usage conditions and not attributable to misuse will be considered.

Warranty claims must be accompanied by the original invoice.

11. Warranty Claims

To file a warranty claim:

- Notify BAG À LUX within the warranty period.

- Provide proof of purchase and evidence of the defect.

- Claims will be evaluated on a case-by-case basis.

BAG À LUX reserves the right to repair, replace, or refund the item at its discretion.

12. Intellectual Property

All content on the Website, including but not limited to texts, images, logos, graphics, and software, is the property of BAG À LUX or its licensors.

Reproduction, distribution, or exploitation of any content without express written permission is prohibited.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Spanish law.

Any disputes shall be submitted to the exclusive jurisdiction of the courts of Marbella, Málaga, Spain, with the express waiver of any other jurisdiction.
